What is new technology law?

New technology law is relevant to all organizations that use digital solutions in their business. Rapid technological development is accompanied by increasingly extensive regulation, particularly at the European Union level. Our New Technology Law team helps clients identify and address legal challenges that often arise across a wide range of legislative areas. We view technology as a driver of innovation, rather than merely a separate business sector, which is why we support organizations across different industries and at various stages of development of their digital projects.

Legal protection of brands and products

Brand protection includes a range of legal tools designed to protect names, logos and other valuable brand elements, such as a product’s distinctive appearance, shape, sound or scent. Our support is based on a strategic approach to the client’s brand and includes brand clearance searches, support with naming processes, and comprehensive assistance with trademark and industrial design registrations

  • Who can benefit from legal protection of brands and products?

Brands are used by businesses and professionals in every industry, regardless of their size or stage of development. Legal protection of brands and products is recommended both for online businesses and for organizations providing physical products or services.

  • When should you consider establishing a family foundation?

It is advisable to seek legal protection when starting a business, launching a new brand or introducing a new product or service. This helps protect the brand’s market presence and safeguard the investment made in its development and marketing.

  • What are the benefits of legal protection for your brand and products?

Legal brand protection helps build brand recognition and protect the brand against current and future competitors. It safeguards the brand’s long-term value and helps build trust in the company by ensuring its continued presence under the selected signs.

We develop an appropriate strategy where an infringement is identified, or claims are received from third parties. We conduct proceedings before patent offices and courts concerning infringements of copyrights, trademarks and designs. We handle opposition and invalidity proceedings. We also conduct negotiations and participate in settlement discussions.

FAQ – New Technology Law

What does new technology law cover and who is it important for?

New technology law covers all legal aspects of using digital solutions in business. It applies to any company using new technologies, from e-commerce businesses and fintech companies to industrial organizations. This area includes intellectual property protection, such as trademarks, IT law, including implementation agreements and licenses, data protection regulations such as the GDPR, and new EU legislation such as the AI Act. It enables organizations to identify and address legal risks associated with innovation at an early stage.

How can a brand or product be legally protected against copying by competitors?

A brand and digital product can be protected using intellectual property tools, primarily by registering a trademark for elements such as the name or application logo and an industrial design for elements such as the graphical interface. Before launching a new brand, it is also worth confirming its uniqueness by conducting a brand clearance search. In addition, appropriate agreements should be put in place to ensure that copyrights are transferred by the creators. Such protection safeguards the brand against copying and supports the development of its value.

How can artificial intelligence be legally implemented in a company?

AI implementation within a company must comply with both existing legislation, such as the GDPR, and the requirements of the EU AI Act. Before implementation, the company should inventory its AI systems, identify potential risks, such as incorrect algorithmic decisions or privacy infringements, and take appropriate mitigating measures. These include ensuring transparency in AI operations through documentation and explainability measures, clearly defining the parties’ responsibilities, for example in agreements with providers, and providing appropriate staff training. This enables the company to use artificial intelligence legally and safely.

Does my company need to prepare for the AI Act, and when does it apply?

Yes. If your company uses AI, it will need to comply with the requirements of the AI Act. The EU regulation is being introduced gradually, and some obligations have applied since 2025. Among other requirements, the AI Act imposes obligations concerning algorithmic transparency, documentation and human oversight of AI systems. Importantly, it applies not only to developers but also to organizations using ready-made AI tools, such as chatbots. Any organization using AI should prepare in advance to avoid penalties.

What should you consider when entering into IT agreements and developing mobile applications?

In IT projects, it is essential to regulate the relationship with software providers properly. The agreement should clearly specify who will acquire the copyright to the resulting solution or the terms of the license under which the company may use it. It should also define the contractor’s liability for system defects and infringements of third-party rights, provide for contractual penalties for delays and ensure the project’s compliance with the GDPR and open-source license terms. A properly drafted agreement minimizes the risk of disputes and ensures the project’s legal security.
